LANDHOLDER AND SETTLEMENT HOLDER
OTHER-THAN-LAND HOLDER
'Settlement holder' is defined
under Section 3(h) of the Assam Land and Revenue Regulation, 1886.
Settlement holder by definition, "is a person (other than a proprietor) who
has entered into an engagement with the State Government to pay land revenue,
and includes a landholder.”.
'Landholder' is defined under
section 8(1) (b) of the Assam Revenue Regulation, 1886 as a person who has
acquired any land "under a lease granted by or on behalf of the Government
the term of which is not less than 10 years". He holds the land subject to
payment of land revenue. Thus, he "enters into an engagement with the
Government to pay land -revenue," and falls into the broader category
called "settlement-holder". The only thing specific about him is that
his engagement is for a definite period of 10 years or more which, of course,
leads to other consequences, particularly relating to the quality and quantity
of rights.
So, settlement holder is a genus
of which landholder is a species. The history of land administration in Assam
(barring the permanently settled areas) under the British rule during the
nineteenth century is really a history of the evolution of these two classes of
holders of land.
